Maternal uncle sell my mother owned shop after her death

My maternal uncle illigally sell my mother's shop after my mother death, as I am the only daughter of my mother I want to get back my mother shop but my maternal uncle not giving me the original registy. What should I do to get back my mom's shop bcoz my maternal uncle sell this shop without my knowledge and signature. May be by fake signature, but I recently get copy of shop registry from tehsil and it is still on my mother name now what I do.

if you have the copy of the registry then file the criminal complaint along with civil suit of declaration that firstly you are the owner and then also file criminal complaint against your uncle then also you will get theproperty back . jagdeep pal singh randhawa

In case you are in possession of the copy of the revenue records and it shows that the shop is in name of ur mother, you therefore can not say that ur maternal uncle has sold it off. But it is recommended that you file application before police and mention that your maternal uncle has given the shop on rent or on lease to someone. During investigation he will have to state the truth and you will come to know about it and then you can ask police to register case against him accordingly alongwith the persons who are keeping possession of your shop. you may have to file civil suit against your uncle and his associates and also take criminal action against them.

If it's already in your mother's name then you need not do anything. If its in municipal area then just get the record of Office updated in your name. Issue public notice to protect your title. A shop cannot be sold legally without signatures of owner. If he sold the shop without your consent then go and file police complaint against your maternal uncle for forgery and cheating. And challenge the sale deed if any, in the name of new person by filing suit before civil court.
