Married woman`s right over her fathers property who died without a wil

My brother has refused to give me money which was actally mine. My father died without a will and so me, my brother and mother have equal right on his property. However my brother has taken all my money and refuses to give it. My mother supports my brother. I am a woman now married with children. I am a hindu.
You have to file a suit for recovery against Legal heires of you father.As you have stated your brother is in custody of money .That means he is successful to get mony ,bonds etc in his favour which is per say wrong .For Property you have to file Suit for partition.
If you father died after 2005 without will you are equal share holder in father's property.if your brother is not willing to give you your share you can file partition suit for your share .It doesn't matter that you are married
Yes u have full right over the movable or immovable property of your father. U can file claim petition or suit for declaration before the court . There is no issue whether you are married or not. U can
