Maintenance charges due of previous owner asking us to pay

Dear Sir I had purchased a resale flat in May 2014. Society was not formed then and I took NOC from the builder on standard format of HDFC Ltd. By getting NOC, I thought that all dues of the owner will be cleared before issuing the same Society was registered on April 2015 , Members were elected in August 2015, now they are asking me to pay the maintenance charges for the period April 2013 to May 2013 ,Previous owner had taken possession in April 2013. Am I liable to pay previous owner's due ? Can the society charge me maintenance charges for the period before it came in to existence ?

You will have to pay the maintenance charges demanded by the society. The society can make the demand of maintenance only from the member and not the person who has ceased to be a member (seller).

However, you can claim the same from erstwhile owner, from whom you had purchased the flat if it is mentioned in the agreement for sale/purchase that all the liabilities and outgoings in respect of the flat shall be borne by the seller and the seller shall keep the purchaser indemnified against the same.
