Lower floor of building in bad condition effecting my floor

I have a house the upper storey belongs to me while thee lower storey belongs to my 65 years old aunty. She left in year 2000 to a new house. Several times i told her to either sell the house or repair it , but she is no mood to do either. Now her portion is in very bad condition ready to crumble making things worse for me, if i go to the administration they will raze the whole house to the ground making it difficult for me. The condition of my portion is good what to do.

There isn't much you can do in this situation but reason it out with your Aunt because any legal action that you take is bound to expose the fact that the building is no more safe to live in and then there would be every possibility of a demolition. The fact that your portion on the upper floor is in good condition will not be of much help since it probably stands on a weak foundation. I deal solution for you would be to buy out the share of of your Aunt.

In your matter you shall intimate her about the house by way sending her a notice regarding the same. you shall have to execute a sale deed with her to sell the entire property containing your share and her share to you so that the entire building shall be demolished to carry nescessary repairs. You can even execute a requishment deed executed in your favour through her that the entire property shall be transferred in your favour including her share as well and she shall have non objection to it.
