Legal rights of adopted daughter in father's property

18-Jan-2023 (In Property Law)
Hi My mother was adopted by my grandfather. She was her first child. Later my grandfather had two sons. i would like to know if my mother has legal right to my Grandfathers property. My Grandfather has not left any will. And i dont think the adoption was done on paper. The adoption was done within the family. My mother showed my Grandfather on all her papers prior to marriage (Education certificate etc)

Dear Mam,

Your mother has a right in the property of your grandfather equal to the right of her brothers if your grandfather passed away after 2005. In case your uncle's are not giving your mother a right in the property of your grandfather, then your mother you initiate the processes of claiming patiton before the properties are withered away.

Thanks and regards

Adopted child gets all the rights as if born to the parents so she has equal rights along with her her two brothers provided her adoption is legally valid. Even if there is no documents or adoption deed, it can be proved by other evidence including custom.

An adopted child who is adopted as per law has all the legal rights in respect of the fathers property as a natural child. There should be a valid adoption deed or one can show customary adoption . If there is no will the property will devolve as per law.
