Legal right on property after staying for more than 25 years
10-Sep-2023 (In Property Law)
Hi
I am a Hindu.
The house I have been staying in is in the name of my father's brother. But he has never stayed here and me and my family along with my grandparents are staying here since 1988. We have been paying house tax, electricity bills etc. Now my father has expired and all of a sudden his brother has come to claim the property. Do I have any legal right on this property?
Since the house is in the name of your uncle he is the owner under the law. That being the case he is entitled to the house irrespective of the various taxes etc. having been paid by you and your prolonged stay there
What legal right you have depends on what sought of property it is??If it is a self acquired property of your uncle, then you have no right to be exercised over the same.As its his choice to alienate his own property as his own will.Secondly if its inherited property of your uncle then definitely if its undivided you have rights as your father was also one of the legal heirs. Therefore depends on circumstances .Yes on basis of possessiory rights as per Specific relief act certain probabilities can be worked out.
