Legal Query about Selling of Property by Legal Heirs
06-May-2023 (In Property Law)
1. Can legal heirs sale property by just obtaining letter of administration . Property is in the name of father (who expired long time back without any will). Currently family consists of Widow, Son(married) and two daugthers (Married). 2. If yes what is the procedure 3. If no than what is the process and procedure Pls advise. Thanks
Legal heirs can sale property also by obtaining letters of administration, but the legal heirs can also sale it by entering their names in the revenue records/property cards after the death of the real owner of which they are legal heirs. For letters of administration one has to apply to court of competent jurisdiction for eg. In Mumbai, Hon'ble Bombay High Court. You all three can jointly sell the property thereafter.
