Leakage from upper flat informed the society but no legal action taken

Sir, I Praying Motappa Mirashi, am owner of Flat no5, Rajnigandha Apt. Near Bharati Bank, Dhayari Phata, Pune-41. There is heavy leakage from upper flat due to which buckets and pots had to be kept to collect the dripping, effected area are Balcony & bedroom which, is been increasing with time, the situation is getting worse day by day. Afraid, the leakage is indeed, deteriorating the structure & reducing the life of the building. We have informed about this issue to Society for last three years but till date no action has been taken up by the owner of Upper Flat. In view of this, Kindly advice how to take up & resolve this issue.

file another complaint with the managing committee of the society and in case they still don't take any action against the problem you are facing you can file a civil suit for damages against the society and the court shall direct the society to maintain and fix the problem and pay damages of which you have uncured since past 3 years.
