land distribution between 2 sons

Hello sir, My question is as below Q- My father was lived in land from 50 year in village. But the land is on another name. But we stay from since 80 years. My father passed last year. Now how this land distribution between me and my brother. Plz guide me. Because my brother capture 1/2 land.
How could you distribute other person land when you are not true owner of said land.
By virtue of tenancy you and your brother take equal portion of said land, if tenancy made.
If tenancy is not made then you can file civil suit for become owner of said land by adverse possession, but in that case your brother can get half of said land, if you proved that your brother not cultivated land then he can't.

Have ur father made any will or written that the land is divided as per the law if u only to brothers than it will be divided equally only . And if u want half land than u have to file case in civil court for possession of land .
