Land adjacent to house as garden is this easement?

Adjacent to a house is a govt land/ no-body's land. Peaceful, uninterrupted use as garden for about 40 years. Is this easement? What steps are required to make it fully legitimate?
Dear concerned. We fully appreciate that you have been looking after the said land for the last 40 years. However, the use of the land as garden cannot be termed as easement. We are sorry to inform you that therefore, there is no way of making such use legitimate.
