Issues with fathers property divided among two brothers

Hi , I have a issue where in my father's house was divided through a partition deed between me and my brother. its a single house in which iam living currently. the partition deed is done on papers but the house is not divided . My brother wants to sell his portion to outsiders and he did not inform me about the same. I had filed a case for injuction in court and its pending. he had made agreement with other third party to sell the house he does not want to sell it to me as i would ask for less as i want to my fathers house to be in family. can he sell his portion of land when case is pendi

Hi.
Your brother cannot sell when the case is pending in court. Moreover since it is a residential home obtained on partition you have the first right of refusal. If your brother thinks you might not offer him market rates he can ask for a valuation of property by a valuer and quote a minimum reserve price. If both of you refuse to buy then a third person /outsider can buy .
