Issue in celebration of festival on common area of society

Occupancy in Society : 30% (600 out of 2200 Flats) Builder is maintaining society. No RWA is formed. Society Residents is planning for Holi Mela on Holi Night. For Mela expense, Resident want to sell Food counter to vendor and total amount received by selling counter will be used in organise Mela such as Tent, DJ, Rain Dance, etc. One of resident who don't want this celebration is accusing volunteers and threatening by notice that they are using common area for commercial benefits. Please let me know will that person issue legal notice and what is the counter for this.

You must use the common facilities with the consonance of all the residents or atleast the majority of them. If the society funds are not being misused and the residential premises are not being used for commercial purposes then you can proceed without any problem
