25-Sep-2023 (In Property Law)
Hi this is regarding the property issue. My mother is widow and we had been residing with my younger mama that is my mother younger brother since last 38 yrs. Recently he had passed away without any will. And now my elder mama is claiming his entire right over the deceased that is my younger mamaji house. He has refused to give us our any share when my mother requested him as he says its his now and sisters dont have any right in it. So kindly suggest whether my mother has any right in share of this house being the sister of the deceased.

Sons and daughters have several rights as a coparcener. For instance, they get a right in ancestral property by birth; right to survivorship: if one coparcener dies the property gets divided among the rest. They are in joint possession and ownership of property and if they want partition, they can claim so by filing a partition suit.
