My uncle(father brother's) is fighting with us every time for taking the portion of 1/3 of our house,my grandfather made a will in the favour of my elder brother and in NAGAR NIGAM and house tax bills is name of my father,is we eligible to send him notice regarding leave of our house or is he eligible to case a file against will of my grandfather..
If the said property was bought by your grandfather through his own earned money which makes him the sole owner of the property, then he can alienate the property in favour of anyone he wishes to. Now as per the facts provided by you, the said property was transferred in the favour of your elder brother making him the sole owner of the property. Thus, your uncle can not claim any share in the said interest of your elder brother in the said property.
