Information on allotment of plots by JDA

27-May-2023 (In Property Law)
Generic questions. (1) Isn't is unfair (it may be legal though unless challenged against by esteemed lawyers like yourself) that JDA charges market rate for every inch of plot (especially in the cases of auctions) and on top of that development charges and lease rental every year? (2) And then again how can a property be given on lease (even for 99 years) after charging market rate upfront? (3) Isn't JDA supposed to provide sewerage in the colonies designed and sold by JDA? (3a) If not, what are they levying development charges for? (3b) If yes, what is the recourse for citizens if JDA doesn't provide sewerage? (4) If there is a delay in getting patta from JDA, is there any way to get it issued with fair and minimal penalties? (4a) Is there any limit JDA can charge for the delay in patta in conjunction with (3b) above? Thanks in advance for to the point answers. Regards

Sir JDA has been involved in litigations on a war footing since its inception because of the questions you have in mind on various occasions JDA has been penalised for wrong practices and the lease of 99 years is because the right to property is not absolute is constitution still a right of 99 years is considered infinite till the govt acquires your property for public use
