Inclusion of my name in property

My mother and father are joint owners of a flat. After expiry of my father, mother wants to either transfer the property or add my name as a co-owner. Also I have one elder brother, who does not want any claim on this property. Please advise on a tax efficient method, and required formalities. Also, how to intimate legally to society about this. We are Hindu Bengali Kayastha

Your mother can make gift of that property to you. According to society bye laws after death of legal owner then nominee for that property can be put on official record. For more information revert back to me.

Ask your father to make a gift deed and register it in your name. Or he can execute WILL which can be enforced after his demise. But getting probate to the WILL is costly affair and so it better if your father puts your name during his lifetime.
