Upon your father in law's intestate death, his properties shall devolve equally on all his legal heirs. Your husband being one of the legal heirs shall be entitled to one such share equal to that of others in the property. However as far as this share is concerned he will be the absolute owner of that and he need not take your consent or permission to transfer his share to his mother or anyone. Legally you cannot raise any objection to this. It is upto his mother to bequeath the same to her son or you at a later stage.
