I to get a stay order on my grandfathers property

16-Feb-2023 (In Property Law)
Hi.. I wanted the info regarding a property matter. I am Hindu. I want to put stay order on my grand parent's property in which my dad alone is presently staying. I am the only daughter of the house. My bhabhi never liked me. She put my dad and brother against me. My dad and brother stopped me and my family from entering the home..long back due to which me n my mom were emotionally tortured. My mom couldn't take it..she was emotionally weak as she didn't have any support from her husband and son.. Both of them never listened to her. She had an attack and expired few months back. Even when my mum is gone..my family behaves with me in same rude way. I want my right in my own home. The property was given to my dad by my dadaji. My dad has power of attorney. My brother will grab the house when the time comes. I want to put stay on my dad's property so that my brother cannot sell it and take all rights on his own. I want rights in my own house. Could you please help?

You have to file a suit for partition and get your share in the property.it appears from your query that you are having a brother and a father apart from you .so property has to be divided meats and bound between three of you if possible or it has to be sold and each one of you will get share.

you have to file a suit for partition seeking your share in the ancestral property in the same petition you can ask for stay against your father and brother so that they may not create third party rights in the property.

For legal solution, please contact with all documents. If they are not available, write down the history of ownership of the property including names of all concerned and connected. Remember, stay is only temporary, we should aim to get you declared as owner
