I sub-leting legal in India for leased property

02-Jul-2023 (In Property Law)
A friend of mine has offered to lease his residential property to me and has no objection in me renting it out to someone. Can someone please advice on how to go about this arrangement, what is the paperwork required for this? What agreements are needed between my friend and me and with the prospective tenant?

Please check the rental agreement entered into between you and your friend. If there is a clause there which states that you may sub-let the property, you are fine to go ahead with the same, provided you execute an appropriate agreement with your prospective lessee. If the rental agreement between you and your friend does not contain such a sub-letting clause, get a no-objection certificate from him on duly registered stamp paper.

A owner/ lessor can legally permit his lessee/ tenant to sublet his premises. This is going on in many premises. You can get a lease agreement written accordingly, by any advocate. But other provisions too should be properly drafted.
