27-Mar-2023 (In Property Law)
We are two brothers. After my father's demise me, my younger brother and my mother are the legal heirs. But offlate due to some disturbance I don't want to claim any rights to the property. I want to give everything to my younger brother. How can I do it?

That's seems a very very well gesture. But in order to relinquish your rights, its important to know what types of property your father possessed. Different types of properties have different procedures.

There are two options available to you for divesting your ownership and right in the inherited property of your father. The first is by way of executing a registered release/relinquishment deed wherein the shares of the other co-owners of the same inherited property would automatically stand enlarged i.e. the share of the other co-owners enhances proportionately. However, one thing that is to be noted here is that such a transaction may either be in lieu of a consideration or may be even without any consideration. The other option is to gift your share of the property to your brother. However, the same has to be without any consideration.
