if your deceased father was the absolute owner of such flat and that flat are free hold property (if required) and registered sale deed executed in his favour then you and your mother move only mutation proceeding by virtue of registered will executed your father in favour of you and your mother. for legal position no probate required as per registered will or unregistered will. probate are not required necessary in u.p. but optionsal.

First you need to get the Dead Certificate of your father and NOA from all your family members and visit with it to municipal corporations. After submitting fees, they will transfer it to you and your mother.

Based upon your will get a succession certificate from the civil court. It will take around 4-6 months time and some court fees and stamps will be payable. After the court affirms this to be in your name you can then proceed to get the flat mutated in your names jointly.
