How to refund the token money paid for purchase of property

I had signed a Sale deed on stamped paper for buying of a flat from an owner. I then paid him an advance of 5 lakhs. Now I dont want the flat because of delay of over 2 months. He is not returning my advance saying I had agreed to buy the flat. The sale deed was not registered. Please advise whether he can legally not return my advance.

As it is a unregistered document you have to send a legal notice demanding your advance amount lf he refuses then you have to file a money suit in appropriate civil court for recovery of your money against the flat owner
