How to Partition willed property ? Is everyone's consent required ?

26-Apr-2023 (In Property Law)
We got property from my grandmother by will, in that among 8 acre land we got 4 acre but at the time of will not mentioned boundaries for 4 acre they mentioned boundaries for whole 8 acre. Now for sale we need to separate 4 acre or we can sell as it is. If need to separate we need sign of all other peoples related to another 4 acre land?

In your issue as you informed that, you have acquired 4 acers of land by way of WILL from grand mother.

Now you need to do one thing, with consent of the other 4 acers owner, survey the land with the help of any surveyor and request to mark the boundaries in the presence of the said survivor to avoid the future litigations.

Once boundaries are fixed, please put the signature of you and other side person on the said sketch, in the presence of the said survivor and 4 witness to confirm that you have confirmed that boundaries. This will avoid future litigations on the boundaries.

Once it was done you can sell the your portion to any person.

If boundaries are not mentioned your buyers will also not be able to take possession, moreover i dont know how you got independent khata without boundaries. You can come to an understanding about the boundaries with the owners of other 4 acres before selling, otherwise you all need to sign.
