02-May-2023 (In Property Law)
This is in regard to the feedback as obtained in respect to my query by learned advocate. Some points, which i need to ask please. 1) Why should I consult a District Government pleader for the instant case? 2) What are the benefits in approaching and consulting him pl? 3) How do i understand if the said plot of land as owned by present co-owners, in my original query is unencumbered pl? I mean what points or factors strengthen the above issue.?

Sir if someone has intention to cheat you he will. Because all his energy will be burned up to think how he can cheat you. Now as per the original question. I you get a original registered deed paper there in the back of the first page in which registry it was registered will be written. On the first page it will be written in which book and which volume with their page number from X to Y will be written. Now only thing is you have to do a searching in that particular registry office and can also apply for certified copy ...If the certified copy is ditto as the original you have hands upon. Understand that the original is original. If still you are not satisfied contact me as their are others way too.

In order to ascertain whether the property is free from any encumbrance, the searching action and legal report thereof as regards authenticity of the property registered Deed is a must prior to investment decision. The District Govt Pleader/his authorised under officer after due diligence is empowered to unemcumbrance certificate.
It is always advised to have such certificate from the District Govt Pleader lest one encounters legal hurdles in future.

In respect of property papers one sees the validity of the papers and whether the property is not unencumbered by way of a mortgage or claim or attached by court. For that one must search in the courts and the registry offices pertaining to where the property lies and the municipality corporation as well as the BLRO. Consultation with district government pleader is not clear as to what you are referring to. As a pleader is an Advocate so if he is aware of the papers and can provide you with the originals then you go for inspection but it would be still prudent to go for official searching
