How to initiate partition of joint family property

my mom dies without making will...we r 3 siblings...i lives seperately..my 2 siblings living in my mom house...now as we want our partition in that house..my siblings r not ready...n they wants to renovate that house...so we want to stop thm...bcoz we want 1 share first....can we bring stay order...can my siblings chalenge my stay order n start renovating that house...we can we do to take our share of the house.m.
The best way out is to initiate a Civil suit for Partition of joint property. You can file for seeking an injunction on the valuation of proprty and stay for renovation till valuation of share of each party having share in the property.

Hi,
You can file the suit for family partition , as there is no will of your mother the property will be divided equally among the siblings, in the mean time you can file a suit for stay on the house if you want to stop your brother from making alteration in the flat .

If your mother deing interstate that you can file a civil suit for partition of joint property and in said suit you can ask stay order from court.
