How to go about division of property

We are belonging to Hindu family.We are two brothers. My brother and my aged mother are staying in my mother's house. It is now in my mother's name. My brother does not want any share at present. What is the procedure to include my mother and myself without my brother for this property.

Make a joint ownership deed and registered the same before the Sub Registrar office and take your brother's signature for relinquishing his right in the property by mentioning the same in the deed before that your mother has to revoke the previous sale deed which is in her name. Consult any advocate.

Property devolved to you both brothers is self earned property of your father so your sister is bound by the will.They have no right in self earned property of your father.so far as cash is concerened the same principle applies.so your sister have no right of claim over movable and immovable property.

If your mother willed for all property than your sisters are not entitled for that..one More gd thing in your case that your father expired in 1997 so both of your sister are also not entitled in ancestral property.... Coz Hindu daughter got rights in ancestral property in 2005.

need not to worry the will is in your favour and it is enough, you can sell your house need not to give anything anybody .
