How to get stay so as to prevent cultivation on land

we have grand father agricultural land in .it is being used by one of my father's brother. now my grand father is not alive. my father wants to get stay for not using for cultivation by his brother. whether he can get stay

Sir,

whether the land you narrated is not partitioned among your father and brothers? then your father can ask them for mutual partition and if the part belongs to father after partition your father's brother cannot cultivate. Now if the entire land is cultivated by your father's brother then your father can ask the yield for his share of land.

Yes you can get a stay provided that you can prove you are the owner of the land.

You will have to file a suit for an order that your father's brother should not interfere with your peaceful enjoyment of the land.
