How to get share in property if parents died intestate

We are two brothers, dad died in 2011 and mom in 2014 without writing any will. Due to my brother’s aggressive character and for the job purpose i moved to another state after coming back to home town again this month i got to know that my brother dissolved all my mom’s gold and dad’s bank savings and fixed deposits and he sold out many of the house hold things which belongs to my dad. We have two properties in two different places, now my brother wants to sell one of the property for his money needs. Both the properties are earned by dad only. Please tell me how to get my share in all those properties and how to take a legal action to stop the property selling?

Dear Concerned,
Well, there are several bright spots in your case. Firstly regarding the property you can file a partition suit to get your share of property, regarding the bank balance and Fixed deposits of your father you can comfortably file a Rendition suit and recover it from your brother, and Gold Jeweler and for other house hold items, if you can produce substantial witness that your mother left jewelry worth certain amount even that can be included in rendition suit. You may contact a practicing lawyer to initiate legal action against your brother. We do also deal with such cases.

Dear sir as per your query the properties belong to your father and being the legal heir you have all the equal right in property you have the right to approach court of law and you can file a partition suit and file for injunction on properties.
