How to get patta in one's name by the ASO

12-Jul-2023 (In Property Law)
I have purchased part of land of 0.20 Acres (Out of 1.08 acres) of land from son of a deceased land owner during 2003. Landowner of the land has already expired in 1990. After filing mutation case, the local Tahasildar has already issued patta(Right of records)over the land purchased. Then I have made boundary on the plot and depositing land revenue upto 2014-15. During 2013, land settlement camp establishment by the Govt. & I have file a Rent Case for settlement patta. The Asst.Settlement Officer has recommended our possession over land and recommended for patta. But during 2014, a person had filed a Appeal Case before the Addl.Settlement Officer with a sale deed that he had purchased entire land during 1980 but not mutated the land in his name. The ASO has issued patta to him rejecting our Rent case . The ASO has not issued any notice to us and rejected our record of rights exparately. What legal step shall be taken?

You have every right to seek redress against the ASO who has done this without giving you a chance of hearing on the basis of your ROR. File a complaint with DLRO attaching with all details and pray for cancellation of the mutation.

Dear Client,
As per the details provide by you here it is suggested that you can file a case for declaration of your right in Civil court but it is emphatically bad that your purchase is bad in law if the other side have purchased the same property from lawful owner prior to you, in that case your case is weak because it is the onus of the purchaser to check the legality of the purchase.
