How to get anticipatory bail

25-May-2023 (In Property Law)
Anticipating bail is rejected from Dwarka session court, then I apply in high court for anticipating bail but it gives date 23 July. My question is that :- 1) police is arrested or not before 23 July 2) can I again apply in Dwarka session court or not ( Hindu religion)

Hello,
For the query you posted, I would suggest the following:

Indeed you can apply for the same by mentioning it before the high court only. And showing the urgency in the matter. For which reason high court itself can take up the matter early.

I hope that answers your query.

Best.

Until and unless anticipatory bail is granted the accused can be arrest at any moment. The mere filing of anticipatory bail does not curtail the powers of police to arrest the accused. The clouds of arrest dissipate only when the court grants anticipatory bail.
I don't know all facts and under which sections you are prosecuted.
Even did not understand why didnt your Adv oppose the date of hearing.

See in the case of anticipatory bail if the date is given for July from High court then you should find out whether the high have given any interim protection to you or not in the form that no arrest till the next date of hearing and further try to find out if any condition has been imposed or not while granting such interim relief. For your second question. Whether police can arrest you or not that also depends upon whether any interim protection have been granted or not. If it's granted then they will not arrest else they can arrest depending from case to case. Now answer to your last query whether you can again apply in dwarka court or not for that my answer is no since you application is already pending before the honble high court hence you can't file in sessions court before the decision of the high court application.
