How to gain possession of property from an illegal occupier

My father had purchased a piece of land in 2004. It also included the house of the previous owner. A tenent was living in a room of the house. Since the tenant was poor, my father allowed him to stay on till the time that we didn't start any construction. The rest of the house was demolished. My father did not demand any rent because he was poor. He continued to enjoy rent free accommodation. The sale deed makes no mention of the tenant or the room that he was occupying. It only mentions the plots of the land and their respective areas. My father passed away in 2011. I recently decided to start developing the said property. I, therefore, requested him to vacate the premises. But he has now outrightly refused to do so and is demanding alternative accomodation in exchange. He also has encroached upon the adjoining Railway land and built his house there. How do I get him to vacate my premises? What are my options and how much time do they consume? Please advice.

I perused meticulously your grievances and found that you want to vacate your tenant from your premises, hence I would like to inform you that you have one option to file eviction suit before the Court of SDO under JBC Act, 2011 which will take some times. As per the law you have one more option for file a suit before the Appropriate Court in which you can claim your possession over that property which has been encroached by the tenant and also demands possession from the court. it will take less time in compare of eviction fill in the Court of SDO.
