Ok, sir you have to hire an advocate and he will do the rest just tell him your requirement and mention him the quantum of land and in a partition suit how many parties are there it has to be clear too. Now if all the parties are ready for partition than go for settlement deed which which will be cheaper and way faster... I suggest you to talk to any one of lawrato partner and do the needful as all of them are scrutinized and are expert in their field.

In case of partition by mutual consent, a partition deed is to be executed by the co-owners. The same is to be registered at the office of the sub-registrar of the place where the property is situated as in case of any other registration. The applicable stamp duty under law is to be paid for each share of property. The Deed to be executed on a stamp paper. The share of each owner should be clearly and explicitly specified.
2) If the partition is not through mutual consent,a partition suit is required to be filed in the appropriate court of law.
3) Partition deed creates new owners of the property.
4) property partition is subject to inheritance law.

Dear client,
As per your details it can simply be said that you have to send notice to the other co-owner seeking partition of the ancestral property by metes and bounds and if they don't proceed with your request then you can file a partition suit in the court of your concerned jurisdiction but keep it in mind if you are seeking injunction against them then sending notice may alert and they may file a caveat and in that it may not be possible to get an order of adinterim injunction.
