How to file for partition under Hindu law?

I wanted to know the laws while dividing the properties in joint Hindu family, as our family has some critical issues. My dad has three brothers in which two of them work as a joint family, my dad is the youngest brother so he is always put down, my dad's elder brother known as karta has different mind, all the properties and the bussiness done in the family are being done in my dad's elder brother sona name, so I wanted to known if we divide will my dad get the share of equal property which is in his son name?

If the referred property is co-owned by your father, the Hindu Succession Act need to be considered. For the purpose of eligibility and share of property , section (8),(9)&(10) to be referred to.For further instructions contact lawRato.

In HUF all the male members of the family has the equal right in the property. However if the property which has been taken under HUF in that event you have seek your proper right whereas from your question it is not clear whether the division has to be made out of HUF or the partition of properties between the brothers owned by them from their predecessor in interest.
