How to enforce lease dead
14-Jun-2023 (In Property Law)
Lease did of 99 yrs with my Uncle but now he denyed this agreement and forcefully he remove me in my house what can I do now.
you have not mentioned the period already availed after confirmation of lease deed by your uncle in your favour and you have also not mentioned whether the said lease is registered one or not. If the deed is not registered in that event the same may be treated as month to month tenancy and as per the default clause of the said deed your uncle can sue you in the appropriate forum of law but he can not remove you forcefully from the house what ever be the case is. You please file a case against your uncle in the civil court for getting your title perfect from dispossession immediately in case it appears to you that your uncle may use force to remove you from the house. Seek appropriate advise from the counsel of your jurisdiction.
Dear client,
In response to your queries I would like to state that if you are forcefully and illegal dispossessed without due course of law then in that case you can file a for restoration of possession under specific relief act which is summary trial and speedy disposal.
