How to divide property of will to separate from brother

My grandfather died when I was a kid. Since then my Uncle had control over the property. Now, they are using as per their will. I and my father discussed to get it separated from them. What are the things we should prepare before talking to my uncle over this?
You have the right over the said property of your Grandfather. You are an legal heir of your Grandfather. First talk to your Uncle about the division of the said property in equal shares between your father and your Uncle. If he denies for the same, you can file a civil suit claiming your rights over your share of the property. just make sure you have the documents and proofs about the ownership of the said Property of your Grandfather.
You need to know details of your grandfather's properties. If your grandfather died without will, then all his legal heirs has right over the property. You need to discuss with your uncle about your father's equal share and if the discussion fails than you can file partition suit.
