How to divide property legally between all the legal heirs?
09-Mar-2023 (In Property Law)
My Father in law has 3 properties. 1 A old house in a piece of land where he lives with his son. 2. One piece of agricultural land 3. A house site. Above properties belong to his father. Property #1 ( house with land where he stays now) was purchased by his father and transferred to my FIL during his life time. My FIL paid some portion of the loan taken by his father. Now he is the absolute owner. He has 2 daughters and 1 son - all married. His son wants all the 3 properties and not willing to share with his sisters. But, my FIL wanted to give the property to all 3. Kindly advise what to do. Regards
Your father in law can divide the properties equally into five shares if your mother in law is there. The properties can be registered through a partition deed. If the son has any issues let him go to Court. Feel free to contact me along with documents.
Your father in law ready to share right? As per law your wife have right to ask her father property .. And your wife can file the partition before the court definerly your wife get her share...
Since the properties comes through your FIL's father, it becomes joint family property of the family. recent supreme court rulings the both 2 daughter and son is having equal rights over the property. you people can proceed further by filing suit for partition.
