How to distribute and transfer father's property after his death

sir i want to know the process /documentation ,for transfer of property which is in our fathers name(died,without will),mother is also died, in favour of we three brother and one sister(married)..and if sister want to leave her share in our(three brothers)favour ,what to do,pl advice in both the cases.

Sir,

Get the Legal heir certificate, take RD from the sister if she is ready to relinquish the property, then get the property mutated accordingly.

Property will be distributed among all the brothers and sister. She has a legal right in her father's property. But if she relinquishes her right by executing relinquishment deed then only her share will be divided among all the brothers or in favour of whom she relinquishes her share. Convince her if you can do so. If all of you agreed for each one's share , you can register a partition deed. But if there is any problem, you have to file a case for partition, then the court will decide who will get what share. Make up your mind and revert me. All the best.

If every thing is settled between all the brothers nad sisters then a family settlement will be made and those who did not wants share they will make a relinquishment deed in favour of others who wanted the same.

you can take the succession certificate from the district court and after showing that certificate to registarar than registrar office will transfer the property in your name. hardely one year will be spent in court proceedings, than you will become the owner of that property.
