How to determine shares in jointly held property
14-Jun-2023 (In Property Law)
Hindu joint family father property earned in 1946,1958 but father's deaths in 1972 his two daughters and two son but no any property divided between all what share of in daughters and sons or two sister are gifted in one brothers own share of property
Which husband is no more? If both are no more, in that case it is to be seen whether sons were adopted by subzequent husband. If adopted, all have equal share, else it will be a matter of proof / arguments.
As per Hindu Succession Act daughters will get shares. You all brothers and sisters sit peacefully and settle property and prepare Batwara schedule and batwaranama. For this pl contact your local civil advocate who may guide you properly.
