How to claim vested interests in ancestors property

24-May-2023 (In Property Law)
I have a brother and 4 sisters.my mother got some property from her parents. Now my mother was cheated(since she is mentally not stable and listen to others and do the things)my brother and my sisters sold that property taking my consent i.e. I signed but later they denied to pay me any amount obtained i.e. There were cheques given to my name but those cheques were taken away by my brother. So the question is do all children have the rights on the mothers property? Since I have already signed is it possible to obtain my share after this cheat. I only have cheque numbers. No cheque copies are available.also have the sale deed which clearly shows the cheating made since my brother took 4times the amount that was given to me( even that didn't reach me). Kindly advice .

If your mother was the absolute owner of the property you are mentioning she had every right to sell it off without consent of any one else. Whether a property is a woman`s absolute property or not depends on how she came to get it.

You can inherit your mother's property. But it is your foolishness that you have signed and not taken the amount while selling the property. Now you can't proceed on cheques also as you don't possess that and you can't do any thing by keeping that cheque numbers which is not enforceable under law. Your ignorance towards law is not excusable and you have lost your rights.
