How to claim share in joint property forcibly acquired by joint owner

house purchased by both brother in west bengal mentioned in registry. I am working in Bhagalpur Univ. Bihar since 1988. I will retire next year. How will get my house? relegion hinduism

If you are the joint owner of the property then you can file a partition suit in Civil court having jurisdiction to claim your share. But before that you may issue notice to your brother claiming possession of your share.

Sir,
As per your inputs in question, you can get the house by demanding partition on metes and bounds and recovery of possession by final decree of partition on the basis of your share in the deed. This process is applicable only when the said house is purchased with undivided share.
But if your share is defined in the said deed you can file a suit for ejectment of tresspasser and recovery of khas possession with damages.
