How to claim ancestral property if father left us

10-Mar-2023 (In Property Law)

My family (mom and dad) lives in a village near gaya. We are dependent on our land for livelihood. My grandfather left our village 25 years ago and married some other lady. He had a job but never gave us a penny. My father is not mentally sound so we are entirely dependent on that land. This year we had to sell some land for my higher education but out of nowhere my grandfather comes and claims all the land. So if we file a case on this what outcome is expected. Also the land in ansectoral and currently on my great grandfather's name. Please suggest.

If the property is an ancestral property the property will be distributed according to the Hindu Succession Act. All the legal heirs will have share in the property. Your Grandfather cannot claim for the entire property as it is an ancestral property
