how to build house when property has stay order from court.

we have land in himachal padesh and land is belongs to my three elder uncles and my father and still land is not been divides amongs them but my all three uncles were passed aways and now one of uncle daughter put a stay on complete land from court. now my father want to bulid house but the daughter of elder uncle is not permitted to bulid house. so just in want to know how i can bulid house there..is there any legel way kindly help us.
If the stay is on construction of any house or its repair then you have to take permission of the court for constructing new house or repair to existing house as may be the requirement. It shall be better to engage an Advocate.

To answer this question, I need the copy of stay orders, so that i can determine on what basis the stay have been allowed .
If the stay is on the basis that there is no partition , you can file the suit for partition or you can mutually divide the property according to the shares .
