How to appeal stay order in court for house for rent

I am Hindu and The Concern is Our house is owned by my Late Grandfather but my Uncle Gives some room for rent and after my Father's death,He(Uncle) and Grandmother put mental stress and Forces my Mother to Live in Particular 2 rooms out of 6/7(very small puja room) in the house.So my Question is can I or my Mother appeal for Stay order on room for Rent in Court Without Be Partitioned from Them(Uncle & Grandmother)??Because although He has right to Live in House but if there is No Partitions between us,how can He put some Rooms for Rent Without our Want or Need, If answer is Yes,the Can We Do the Same?? Please Answer my Queries Thank You.

Now any one rented in this position where your room has been in rent.if present then you can file mutual partition ,in this partition court decide which part is your .if the civil court reject your suit then you come to appeal for stay.
