How can we ask tenant to vacate the property if there is no agreement

One person took the garage space of our premises from my late father in 1975. There was no agreement, but we issued all rent receipts as "garage". After his death his sons are using the space as a grocery shop. We want them to vacate our space.

According to WBPT ACT "Tenant" means any person by whom or on whose account or
behalf the rent of any premises is or, but for a special contract, would be payable, and includes any person continuing in possession after termination of his tenancy and, in the event of death of any tenant, also includes, for a period not exceeding five years from the date of death of
such tenant or from the date of coming into force of this Act.

You can send a Legal Notice to the Tenant to quit and vacate your garage for your own use, if the tenant would not comply then file a suit for Eviction of Tenant in Civil Court. but it is lengthy process of laws.
