How can mother and son get share from my father's property

we are 4 brothers. my mother and father are alive. they do not have a healthy relationship with each other. we also have 3 properties out of which one is in the name of father and 2 in the name of mother. all the income comes and my father collects it. he does not share any income and says he will not give any in future as well. what are the remedies do we have in this. do we have any share in the property/ income coming from the property. can we take any legal action?

Hi the advice depends upon many facts that you are talking about the ancestral property or the property which is earned by your father. And whats the age of all of the children? Suggest you to get in touch with any of the lawyer so that the proper advice can be given.

If the properties in the name of the father / mother are not their self acquired property but are so acquired from ancestral funds, then only you can have a claim on the said properties or the income being derived from it.

Depending on the nature of the properties you may or may not have a right in them. As for the properties in your mothers name the income derived form them must be paid to her failing which she may seek eviction of the tenants therein. As for the properties in your father's name if these are ancestral properties you children will have a right therein and may approach the courts for partition and other reliefs
