How can I transfer ancestral house in my name

15-Jul-2023 (In Property Law)
We are two brothers staying in ancestral house. The house is in the name of our Grand-mother, who had expired long ago. Our father was the only child. He and our mother have also expired. What is the procedure to transfer the house in our name? There is no registered will of either of the deceased person. Please advice

you need not require any will. being successor, you are entitle to get the property transferred in your name. you may consult personally and by looking at existing documents and circumstances we can adopt an appropriate way to get the property muted in your name.

First get death certificates of all the deceased persons. file application for getting legal Heir Certificate from the revenue officer/ tehsil office under whose jurisdiction property situated.
Get a survival certificate from the revenue officer/SDM under whose jurisdiction property situated. Then file application to mutate your and your brother name in the record of the property. It is also advisable to have a family settlement deed.
Opined accordingly.
