How can i sell my ancestral property
02-Jun-2023 (In Property Law)
Dear Sir, My father gifted 8months ago 2 self earned property to me and my brother. And we have divided equally one ancestral property (my father, mother, myself & my brother). While I was in Muscat, last month there was a robbery and death of my father, mother, brother & his family. Now am confused, and want to return to Muscat. But due to property still here, can I dispose mine & my brother's gifted property. And can I also sell the 4 portions of ancestral property and take the money to Dubai invest there. Please advice. Thanking you, ... With best regards,
You can sell your shared property and your late brother property if he is not married.
If your late brother is married if there is any legal heirs alive [Wife & Children's] you cannot sell the property of your brother.
If your late brother is married if there is any legal heirs alive [Wife & Children's] you cannot sell the property of your brother.
As I understand, you are an indian and was living in muscat as nri. Regarding robbery, i understand there is a crminal case pending before the court. it is not clear about the death of all your family members. I presume that robbers have murdered your family members. since the case be pending before the court you are not supposed to alienate the property. u can meet in person with all the relevant details for further advise.
