How can I claim my share in my fathers property

I and my brother with our family are staying at our fathers house ,I am the younger son and the house is on my father's name who is dead now. Mother is also dead. We are only two brothers.Now i want to part in the property but my elder brother is not ready to give me my share. He is not ready to sell the property not to give me my share. He is not ready to take the money from me which i am ready to give equivalent to his share. Basically he does not want to give me my share. The original papers are also with my brother. I do not have any papers. 1. How can i get the original papers of the house. 2. How can i get my share 3. Can i get loan from bank
As per your query, you can get a share in the property by filing a partition suit in the court. Your brother cannot hold on to the property as it does not belong to him. Once you file a partition suit, the property will be divided equally among both the legal heirs.
