How can I claim in my mother's property

Iam Hindu Thiyya Kerala. I am the only son of my father and mother. My father is 69 now. My mother who was 68years passed away on last January 15 (2016). The house we are staying belonged to my mother. That is the only property we have. She was the one who spent her money for this house. Now my father is planning to remarry without my consent. So now who will get the property.?

You can claim equal share in the property. The property will be divided equally among all the legal heirs of your mother. The property will be divided according to Hindu Succession Act.

Hindu Succession Act is applicable to you. If a Hindu dies intestate his or her property shared among his/her mother (if alive) spouse and the children. So all these persons will get equal share .In your case if your grandmother is not alive the property can be divided to both you and your father
