How can a ancestral property be divided
15-Apr-2023 (In Property Law)
My Father has 5 sisters and i do have one sister. Our Family have ancestral property of 4 acres. I want to know how this will be divided among all. My Father's sister and my sister are married. And does my wife have any right in the property which i get from my ancestral property ?
The property shall be divided between all the members of the joint family property equally. Your sister shall get a share in the property. However your father's sister shall get a share only if her father passed away after 2005. Hope this satisfies you. You would need to file a suit for partit ion.
If you are hindu these property shall be partitioned first among your father and his sisters, your father shall get 1/6 share if your grand parents are not alive. You shall get 1/3 of 1/6 of entire property after getting 1/3 out of 1/6th your wife can claim her share if any partition comes in picture between you and your children, she can not claim partition.
You can get half of the share of your father's share.
Property will decide first of all among your father and his sisters, there after our will decide between you and your sister.
Better u seek detail consultation by disclosing complete details, so that exactly can be suggested to do..
Feel free to revert back in case you need any clarification.

Sir,
After the death of your grandfather the same be divided equally among the class 1 heirs, but if the death of the grandfather has been done before 2005 Amendment Act .... Then the sisters don't have right in that property ..

Ancestral property is divided in terms of the Hindu Succession Act. In your case, the 4 acres will be divided in six equal parts, among your father and his five sisters (if they are the only legal heirs).
From your father's 1/6th share. you mother, your sister and you will get equal share, i.e. 1/18th share of the total property.
